    Are Ebay subject to the DTI Distance Selling Regulations?

    If so... and something goes wrong, they state that you have to return the item to the seller at your own cost.

    I thought that it was the sellers responsibility to arrange collection?

    Isn't it excluded as Ebay are only facilitators of the transaction and it is between private individuals and not a company? If the sellers is an Ebay shop then they should still be subject to the standard rules and regs

      I dont think there is anything in the DSRegs that says you have to pay for the returned goods, but that you must state your returns policy in the contract, be it returns at sellers cost or buyers cost

      We always pay for faulty goods to be returned, but make buyer pay for postage back if item is wrong size or colour

        The DSR does stipulate :

        1. If suppliers fault.... wrong item, faulty, breech of sale (incorrect product description) not suitable for purpose of use etc then the supplier is liable for return costs

        2. If the buyer simply does not like the item or changes mind then it is returned at the buyers expense.

        DSR does not cover B2B or C2C sales just B2C

          goods bought at auction are excluded, real world or ebay.

          goods bought via Buy It Now, are covered by the DSR.

          The plaintiff will be the ebay user, not ebay themselves.

          Im not sure C2C is relevant - if you are selling a product via ebay you aren't a consumer.
