Out of interest how does the laws of the land regarding emails sent to businesses stand when a business has multiple websites and each receives an email? Is this classed as multiple emails to the same company even though to different email addresses?
Jont, makes no difference. UK anti-spam law only applies to individuals and excludes organisations. You can argue you are an individual in an organisation but I don't think that applies.

Robert, people who use actinic are often individuals who don't like spam (unsolicited emails) which is exactly what your sending. In my opinion failure to recognise this shows a rather self centered view of the world.

Anyway, sending spam is a very short termist thing to do as all you do is get your email address /domain blacklisted so soon no-one will get any emails that you send as they'll all be filtered out.

in light of postpacks response to this thread i thought i'd contact them to complain as they clearly have harvested emails, guess what they have blocked PMs from the community.

Personally i dont like unsubscribing from email lists i know i haven't signed up to as more often than not they are waiting for you to unsubscribe to find out if your email is live.

I'd like to know why they think they can blanket email as i thought you had to have bought from someone, or contact them or agreed to be added to their list before they could market to you. (regardless of adding an unsubscribe)

Here's hoping they get as much bad press from this type of behaviour as they get new business.

I still want to know where they got the addresses from in the first place though

As I said above, the law only relates to individuals. Organisations (and presumably contacts therein) are specifically excluded.

              Hi Again Folks

Jont: Apologies that the targeted feel was an irritation. From a marketing perspective I hope you also agree that targeting is generally much more productive, efficient and dare I say ethical than just simply hitting anyone. We have added a rider to our emails pointing out that we do not have any connection to and are not looking to misrepresent Actinic and have added a link to a policy brochure page where one can proactively unsubscribe any email addresses before even receiving a mail, which I hope you guys on here will find of personal benefit to ensure you do not receive any further mails from us which you do not wish to receive.

On to how we are mailing the copied to mail addresses and why we are using them: As I'm sure you know as developers, every Actinic site has a published open file (pretty much a business card) with all the contact information on. This is where we are pulling the mail addresses from. The reasoning behind adding the ‘copy to’ address to the mail-shot lists was that in larger companies (as opposed to one-man band type stores) it is unlikely that sending a mail advertising our packaging will reach the buyer/decision maker through the sales address. In fairness I'm realising now, (largely from comments here) that perhaps this is not the way to go and after tonight’s mail-shot (which should be complete now) we undertake not to include these addresses.

We're pretty much at the end of the Actinic mail-shot campaign, there is one more group left on the list due to go out this week. We will follow up with periodical offers to those who have not unsubscribed (and indeed this campaign has been very successful and well received in many quarters) but you can rest assured that if you unsubscribe an email address through our systems you will never receive another email from us.

The email in question has nothing to do with any of my domains - it's my personal email and I'd like to know how they got hold of it.

Why not give them a call. They apparently want to discuss these kind of issues with you.

The place to report them if they can't explain properly is http://www.ico.gov.uk/

TBH Mike I can't be bothered to phone them as far as i am concerned i have expressed displeasure in a public forum now I shall simply block their domain through my spam filter and move on. ie treat them in the same way as all my viagra emails. I probably wouldn't have given the initial email a 2nd thought if this thread hadnt been opened.

I was interested in their attitude though, ie if we dont get complaints we will continue with our underhand behaviour. Well i am complaining

I've had a PM to say they've addressed my concerns in a post that is awaiting moderation and to call them if I want to discuss further

                      Errr, I don't think so...

I'm not responding and don't know why they couldn't also explain where they got my address from in the PM.

                            Not impressed at all TBH.

I've been discussing this with Robert and apparently every actinic website publishes a file containing all the contact details on it.

This is news to me, and I couldn't find such a thing on my websites server, but if there is then I think actinic need to look into sorting it.

                                What are we looking for?

                                Not smelling right to me.
