I have just replaced my v7 site with a newly built v8 site and it seems to be working fine, apart from I don't seem to have a keep details private box in the checkout anymore, any ideas??

Could it be in "Design | Text | Web Site (Cont)", and click on "General Information", that you changed the "General User Definable 2" to Keep "Details Private"?
