i want to offer some free digital downloads.
will it be possible to make a new product layout without add to cart button and replace this with a download now button wich will take them to a modified checkout layout that will only include there email field and some text.
but otherwise will function same.

is this worth persueing or does anyone see pitfalls with my plan.

You don't have the flexibility to modify checkout on individual products - but what you can do is create a button or link that directs them to a form, collect the name and email data in the form and when that is submitted, redirect the user to a download link.

can i substitute the add to cart button in a copied product template without having actinic throw horrible messages at me on upload, when it see's the function is missing from that paticular template..

You don't want the add to cart button with all its inbuilt functionality, you want the image file that is used for add to cart, with your own <a href....> </a> built around it. May be better to create a new button for "Register for Download" to better describe what the button will actually do.
