Can we have a tick box for people to opt out of marketing & promotions.

is there a feature to have a tick box for people to opt out of marketing & promotions on the checkout screen. I know they have T & C's but we would like some sort of mailing list set up. I have had a look in the business settings but no luck, any ideas?

They are naturally opted out, you are actually asking whether they want to join in. Take a look at adjusting the 3rd general prompt in the checkout, you may be able to adjust and use that for your purpose.
