no the product was completly removed ie cut from catalouge its not showing
as just deleted or i could have done what you sugested

Did you purge the deleted product from your catalog? If not then that is why you can't create the product with the same ref. In that case, can you undelete the product and see if that will let you into the marketing tab without it crashing.

No i have not purged the site but the item was cut from the cataloge not just deleted otherwise i could have done what you said. but its telling me its still a used product code.

In Access you can check in the Product table, Product Reference field, and see if you can see the offending reference.

Can't you just go back to a previous backup and start your changes again, gotta be quicker surely?
