    Terms and Conditions

    Hi All
I was reviewing the standard terms and conditions, and I find this which comes along with actinic.. I thought that in an online business a contract exists when the buyer buys based on the price and conditions that the seller puts in his web site...is there a need to send an invoice as below?

    ...........................
When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice.

I believe this is usually done so that for example if you have the wrong price on your website (maybe 10.00 instead of 100.00) there is no contract to supply at that price until you invoice.

Although we don't send an additional invoice, unless requested to do so. Many companies send an invoice with the goods as well as, or in place of, a packing slip.

Thanks for your reply..but the fact that a customer buys with a credit card and the merchant gets an authorisation at the price on the web site..can the merchant then invoice at a different price even if an error ocurred?
      TIA
