These 2 quotes contradict each other and are typical of the confusion regarding this matter.
Even if Wesley was allowed to sell his copy of Actinic because he sold his business with it, what is stopping the new owner of the software from taking down that site and starting a new site with different URL, as quoted above by Mark from Sales@Actinic and what is stopping Wesley from starting a new business with a slightly different URL selling the same products with his newly purchased Actinic software?
We should be allowed to sell our costly Actinic software providing that we can prove we are the rightful owners and that the details of the sale are sent in writing to Actinic, maybe Actinic could create a form which would meet their own criteria which would satisfy them. There is ways of keeping control of who has what copy but if it’s not about controlling who has what copy, then what is it about, is it money? Look after your customers and they will look after you!
