dodgy actinic copies being sold

    My understanding of transferring licenses was that you needed written pemission from Actinic to resell or transfer a license, whether it has been used or not.

      You are of course right Jan, in that you do need actinic's permission before a license can be sold or transferred. What we were trying to cover were the different conditions under which Actinic would or wouldn't give their permission. To me Chris was pretty clear when he said:

      I'm afraid that licenses of Actinic are non-transferable once the software has been used to build a site.
      As to Elsie's comment about actinic being inconsistent on this, all I can say is that I'm not aware of any inconsistency on their behalf. I can believe though that if the software has only been 'used' during the development phase of a website but never gone live then they may choose to operate some flexibility in deciding whether that software has been 'used' or not.

        I checked with the seller (being nosey) and they have confirmed that no sites have been uploaded. Why they have opted to describe it as "used" is a mystery.

        Anyway, this is obviously how they've managed to get permission to resell.

            They look legit. (genuine software) Although you'd need to contact each one and establish the licence situation before bidding.

            If a seller tells you the license is transferable and that they have permission from Actinic etc., Then it turns out it isn't and they haven't, the goods are not as described. You then have some recourse with Ebay or Paypal. You would need to check with Ebay or Paypal to see if that recourse is worth anything!

              I have a copy of Business V7 lying on the shelf gathering dust because Actinic said I could not sell it because I uploaded a site. The was in development and was never actually live. I bought developer V7 about a month after buying Business as I thought I could sell it but I was told that because I uploaded a site I couldn't sell it. I don't think that is completely fair as the Business V7 has never really been used comercially, just for development, now its just an expensive mistake I made - not the best way to get a new business off the ground

                @tdw - surely the price you paid for Developer was discounted to allow for your previous purchase of Business? At the end of the day you should have paid the equivalent of one purchase of one Actinic (Developer) product, and that is what you now own (one product).

                If you paid full price for Business, AND full price for Developer, then I would suggest you talk to Actinic again as there MUST be a misunderstanding.

                  I believe actinic offer an upgrade from Business to Developer although they don't seem to mention it on their website. I've already raised this with them as something they should promote but I haven't seen anything done about it yet.

                    Hi, thought i wouls share my concerns.
                    I currently have V6 Catalogue, we are looking into updateing to V7 Business, have spoken to Actinic who told me that there is no way transfer V6 to anyone else. I want to sell on my V6 catalog to part fund my V7 business purchase.
                    If i can not sell on V6 then I will have to wait until i have a spare £799.
                    It seems to me actinic are holding all the cards here.
                    If i buy a car and want to sell it two years later i can.
                    If i but actinic software and want to sell it two years later i can not.

                    I dont see why i should be unable to sell V6 on to part pay for new v7 software.
                    Actinic would get money from me for the new software and a potential new customer who bought my old v6.
                    As it is I am now not giving actinic any money and they dont get a new potential customer.

                    Maybe open sauce is worth a look.

                      Not if you trade the old car in for the new one at a reduced price you can't - the upgrade path will take into account you are an existing user hence the reduced price for "trading in" an older copy.

                        The salient point being that you are upgrading a v6 and that turns in the use of that license in exchange for a reduced price v7. If you purchase a full priced v7, then you still have a fully enabled and working v6 and can use it subject to the terms and conditions of the licensing agreement. However, if you upgrade, you effectively turn in your v6 as part of the upgrade fee... it's not rocket science... as jont pointed out, it's a "trade-in".

                          Seriously, if you are upgrading from one package to another and get a reasonable discount, that sounds fair.

                          If you're not able to get a reduction when upgrading, then that doesn't seem fair.

                          I couldn't see any info on Actinics site regarding costs of upgrades.

                            However, what I wanted to do was to sell my V6, and buy V7 business at a better price through an actinic reseller and not direct through actinic as there price is too high.
                            Is it possable to upgrade through a reseller and thus get a better price.

                              I doubt it Wesley. The reseller hasn't previously made anything on the deal so there won't be much incentive for them to lower their price.

                              You could always make a couple of phone calls though. (or emails) What's the worst that can happen? You'll then need to work out which is cheaper for you. Upgrade through Actinic or buy new from a reseller. From what you say, it looks like the upgrade path with Actinic will be most cost effective.

                                you could always look at the conversion rates for buying from another english speaking country - the price might work out really favourbably....
