My site enables the shopper to select shipping based upon weight. However a shopper has to act responsibly and select the correct insured shipping value based upon order value as well.

"The distance selling regulations are very clear that the customer has a cooling off period that extends up to 7 days after the delivery of the goods.
If the goods don't arrive then it looks to me as if he can cancel the order and you'll have to provide a full refund."
This implies that the legal obligation is upon the retailer should the goods never arrive.
Somebody gave me a link to these t&cs not sure how valid their stance is.
