              terms and conditions

Yes Malcolm, a good read. The business link and other various government sites are well worth looking at for the majority of business related questions.

I will compile a short list of things that I have picked up from Solicitor and post them up.

The fellow is an internet specialist and if a site is dealing with lots of transactions or some of high value then it may be worth considering his services.

If you are not dealing in large sums or high volume then just following the basics should be enough.

One problem I have found previously is that some internet shops have little or no retail experience and in these cases I would certainly follow Malcolm advice and look at business link guides. If you look around on other postings on this forum you will see that the customer is almost invincible and the shop owner usually bears the brunt of the out of pocket expenses. I seem to remember Bill having a particular bee in his bonnet about this at one point. (among others I might add)

In my particular situation the shop in question did have retail experience and did seem to have reasonable terms, they used to get questions about returns policy and even when the customer had worn and slightly damaged the item did they return it 'demanding' a full refund including postage due it being the wrong size. The terms are now as far as can taken to try to prevent this happening.

One of the main issues raised was about having the 'Terms' on the home page of the site and for this to be clear about the site usage policy, then for the actual terms of business to be very clear and explaining clearly the refund / exchange policy.

Another useful point was for the 'terms and conditions' to be forced to be read. This is very difficult to implement but by having the accept check box beneath the terms and conditions then at least the user has to have at least scrolled past them to have checked the box.

The final one in this post, about custom made products, very useful where say football jersey has been sold with a players name on the back.

"Please note that the right to return Products does NOT apply to any Products made to the Customer's specification."

If you want to drop a list on email to me, i will make sure the bits and pieces you require are put aside ready for when you want them. Stock levels change quickly on his site. Having said that if not in stock, most things can be obtained within 3 days, just depends how urgent you require things.

                        Cheers
